DivorceContested and Uncontested
Unlike an annulment, which is a pronouncement that the marriage is void, a divorce is the legal dissolution or termination of a marriage.  A divorce may be either contested or uncontested.

A Contested divorce is one within which the parties are unable to resolve certain issues such as the division or property; child visitation, care or custody; debts, alimony, etc.  If the parties agree on all issues, then the divorce is uncontested.

Divorce laws vary from state to state.  In New York, there are seven grounds for divorce:
(1) cruel and inhuman treatment
(2) abandonment for one year or more
(3) confinement in prison for three or more consecutive years after the marriage
(4) adultery
(5) living apart pursuant to a decree or judgment of separation for one year or more
(6) living apart pursuant to a separation agreement
(7) “No-Fault” – that is, the relationship has broken down irretrievably for a period of at least six months.
